The Claim

Background:

Beginning January 1, 1998, California's smoke-free workplace law was extended to include bars, taverns and gaming clubs, making California the first state in the US to ban smoking in virtually all public places. There is significant opposition to this ban and many groups will likely attempt to overturn it in various ways.

This claim will be judged YES if smoking is legally permitted in at least 50% of the bars, taverns and gaming clubs in California for a total of at least 30 days during 1998.

There are a small number of exceptions in the existing law (for example, a bar owner with no employees may permit smoking). The intent of this claim is to ignore these exceptions and to require a court ruling, legislative or executive (such as CalOSHA, EPA, OSHA, etc.) action to permit smoking in at least 50% of bars, taverns and gaming clubs where smoking would otherwise not be permitted.
